The following constitutes the Videography Agreement (the “Agreement”) of VLVideo Studio Productions (the “Videographer”). Please read the Agreement in its entirety and contact the Videographer if you have any questions or concerns about the Agreement. As used in the Agreement, all references to “you” or “your” or the “Client” refers to the signer of this Agreement. Checking the boxes and entering your name below will serve as your electronic signature reflecting your assent to the terms and conditions of the Agreement. You will be able to preview the Agreement prior to its submission, at which time you are encouraged to print a copy for your records.
It is understood that VLVideo Studio Productions is the exclusive Videographer retained by the client to cover outlined event. Any conflicts with other video coverage contracts and any notifications necessary to avoid such conflicts are the sole responsibility of the client.
Client assumes all responsibilities for obtaining any necessary permission, clearance permits, etc., which may be required for VLVideo Studio Productions each event, public or private. Client assumes all responsibility for obtaining and retaining permission for access to any requested camera positions and is solely responsible for the quality of the final production resulting from the use of, or inability to use, such camera positions. The client warrants that he/she has the legal rights to anything VLVideo Studio Productions will videotape, including photos, musical recordings, videotapes, or any other materials delivered to VLVideo Studio Productions for inclusion in the clients video.
VLVideo Studio Productions is not responsible for poor audio if the client (main speaker and etc.) does not agree to wear a lapel microphone, dark or grainy video resulting from inadequate lighting or the refusal of the client to allow camera-top lighting at the reception, or electrical or mechanical malfunctions on location that are beyond our control.
VLVideo Studio Productions will establish an arrival time for the wedding date with the client prior to that date and remain on duty for the number of hours included in the package. Coverage hours included in the package are for the wedding date only and must be consecutive.
VLVideo Studio Productions reserves the right to use videos and photos for display and or promotional purposes. All video masters, raw footage and photographs remain the exclusive property of VLVideo Studio Productions.
Artistic Style. On its own behalf and on behalf of the subject: Client acknowledges that he/she is familiar with the VLVideo Studio Productions portfolio and is requesting services with knowledge of the company’s style and that VLVideo Studio Productions work is constantly evolving; that the VLVideo Studio Productions services are of a unique and artistic nature; that the video may be different from videos done by the company in the past; and that in creating the videos we shall use our own creative artistic judgment to create videos consistent with our personal judgment and consistent with our vision of the event, which may be different from the clients and or the subject’s vision of the event. Accordingly, client acknowledges that the videos shall not be subject to rejection on the basis of taste or esthetic criteria. Additonally it is the client's responsibilty to inform Chris Parish CreativeVLVideo Studio Productions of any specific shot selections in which the client would like captured.
If VLVideo Studio Productions fails to comply with the terms of this agreement due to any event or at beyond the control of VLVideo Studio Productions, including but not limited to illness, accident, labor disputes, acts of God and other catastrophes, or uncontrollable and unforeseeable equipment failure, VLVideo Studio Productions liability is limited only to a refund of all monies received.
The client reserves the right to terminate the contract for any reason up to 5 days after the date of down payment. Should the client terminate the contract, all money paid minus the retainer which is 50% of total cost will be refunded.
VLVideo Studio Productions reserves the right to ask any attendee in which may be inhibiting the ability of the videographer to capture footage to adjust the actions that are preventing the videographer's capturing of said footage. This includes, but is not limited to, standing in the aisle of the ceremony's location, the capturing of footage on the attendee's personal video recording devices, and the crowding of a select area in which the couple will be filmed.
Both the client and VLVideo Studio Productions agree to the terms of delivery which includes final video masterings between 2-3 months after the date of the contracted wedding.
If for any reason the client chooses to change the contracted date he/she agrees to pay additional retainer costs for the second date.
Any overage time that exceeds 30 min will be calculated at an hourly basis of $250/hour. Additional hourly rate will be factored in once the overage time exceeds a 30 minute mark. To resolve this additional cost the client may request a staged couple walkout to be filmed. This decision must be brought to VLVideo Studio Productions attention at least 1 hour in advanced of the staged walkout in order to give videographers time to plan accordingly. If the client fails to inform Chris Parish Creative of a staged walkout, then it is to be assumed that the night will go on as initally planned.
